Summary
Wife's pre-marital Tahoe cabin was paid from a joint account, and the community used it. The expert's Moore/Marsden propertizer was upheld, including mortgage balances estimated from 1098 forms and a $7,000 improvement figure. But the $176,951 reimbursement for interest and taxes was error because the community already shared in appreciation and was never charged for its use of the property. The $3,584 permanent support award was reversed because it tracked the temporary DissoMaster figure ($3,673) with no sign the court weighed the section 4320 factors. Reversed on the interest and tax reimbursement, the equalization payment, the permanent support award, and the fee order. Affirmed otherwise.
What it means for the financial analysis
In a Moore/Marsden schedule, count principal paydown and improvements only. Show interest and taxes separately as maintenance, not as a reimbursement claim, when the community also takes a share of appreciation or used the property. The court accepted estimated mortgage balances built from a few 1098s and statements, even though the documents were not admitted. Even so, put the source documents in evidence and show the extrapolation. For support, a temporary-support software output does not support a permanent figure. The analysis needs its own income and needs findings tied to section 4320.
